Terms of service
These terms are an agreement between you and Rocky Mountain Appraisal Ltd., a British Columbia company that operates LandlordLog ("we", "us"). You accept them when you create an account, buy a plan, or use landlordlog.ca. If you do not agree, do not use the service.
Your rights under consumer protection law come first. If you are a consumer, nothing in these terms limits any right you have under British Columbia's Business Practices and Consumer Protection Act or other law that cannot be waived. Where a term conflicts with such a right, the law applies instead of that term.
1. The service
LandlordLog is a record-keeping tool for landlords. It stores your rental records and applies British Columbia's published tenancy rules, such as the yearly rent increase limit, notice periods and deposit rules, to the information you enter.
2. Not legal, tax or financial advice
- LandlordLog's calculations, dates, reminders, warnings and exports are general information to help you stay organized. They are not legal, tax, accounting or financial advice, and using LandlordLog does not create a lawyer–client or advisor relationship with anyone.
- Results depend on what you enter. A wrong date, rent amount or due day gives a wrong result.
- Tenancy and tax rules change and every tenancy is different. The app shows the date its BC rules were last updated. Before you serve a notice, raise rent, return or keep a deposit, or file a tax return, check it against the Residential Tenancy Branch's own forms and tools, or ask a lawyer or accountant. You are responsible for your notices, filings and decisions.
- LandlordLog does not serve notices, file anything, or communicate with your tenants for you.
3. Your account
- You must be at least 19 years old. Keep your email account secure, since signing in to LandlordLog works through it. You are responsible for activity on your account.
- You are responsible for the information you enter. In particular, you confirm that you have the right to record your tenants' personal information, that you collect and use it only for managing the tenancy as BC privacy law allows, and that you have told your tenants how you keep their information where the law requires it.
- Do not misuse the service: no attempts to access other people's records, interfere with or overload the service, copy or resell it, or use it for anything unlawful.
4. Plans and prices
- Plans, prices and what each includes are shown on the site and at checkout before you buy. Prices are in Canadian dollars. Sales taxes are added where they apply and shown before you pay.
- Monthly plans renew automatically each month, and yearly plans renew automatically each year, at the price then in effect, until you cancel. The renewal date is shown on your billing page.
- The tax-time pass is a one-time charge for 30 days of access. It does not renew.
- Payments are processed by Stripe under its own terms. We do not see or store your card number.
- Promotional codes have the terms stated when they are offered.
5. Cancelling, renewals and refunds
- Cancel any time from Manage billing in the app, or by emailing support@landlordlog.ca. There is no cancellation fee. When you cancel, your plan does not renew and you keep access until the end of the period you have paid for.
- Yearly plans: we email you 30 to 60 days before each renewal with the renewal date, the price and how to cancel. If your yearly plan renews and you cancel within 15 days after the renewal date, we refund that renewal in full.
- Your first yearly plan: if you are not satisfied, email us within 14 days of buying it for a full refund.
- Monthly plans can be cancelled at any time before or after a renewal without charge or penalty. If you cancel after a monthly renewal and have not used the service since that renewal, ask us and we will refund it.
- Outside those cases, charges for periods already started are not refundable, except where the law requires a refund.
- Refunds go back to the card you paid with.
6. Changes to these terms and to prices
- We may change only these parts of the agreement: prices for future renewals, plan features, and terms needed to reflect changes in the law or in our service providers. We will not use a change to reduce your cancellation or refund rights.
- We will email you at least 30 days, and no more than 60 days, before a change takes effect, describing the change and when it applies. If you do not want to continue, you can cancel before then without charge, and a price change never applies to a period you have already paid for.
- The current version of these terms is always at landlordlog.ca/terms, with its effective date.
7. Your data
- Your records belong to you. You give us permission to store and process them only as needed to provide LandlordLog to you.
- You can view and change your records at any time. While your plan includes exports you can download them, and for 60 days after a paid plan ends we will send you a full export on request.
- Keep your own copies of anything important, such as signed notices, receipts and tax records. LandlordLog is a working tool, not a substitute for the records you are legally required to keep.
- Our privacy policy explains how we handle personal information. If we learn of a security breach affecting your records, we will notify you without unreasonable delay.
8. Availability
We work to keep LandlordLog available and accurate, but we cannot promise it will always be available or free of errors. We may improve, change or temporarily suspend features for maintenance or security. If we ever discontinue LandlordLog, we will give at least 60 days' notice, refund any unused part of a prepaid plan, and give you a way to export your records.
9. Disclaimer
To the extent the law allows, LandlordLog is provided "as is" and "as available", and we disclaim warranties that are not set out in these terms, including warranties that it will meet your particular needs or that its results will be correct for your circumstances. This does not affect any warranty or condition that the law says cannot be excluded.
10. Limits on our liability
- To the extent the law allows, we are not liable for indirect, incidental or consequential losses, including lost rent, lost profit, tenancy disputes, penalties or tax reassessments, or for losses caused by relying on a calculation, date or export without checking it as section 2 describes.
- To the extent the law allows, our total liability for all claims relating to LandlordLog is limited to the greater of the amount you paid us in the 12 months before the claim arose and $100.
- These limits do not apply to liability that the law does not allow to be limited, such as liability for fraud.
11. Your responsibility to us
If you use LandlordLog for a business, or to the extent the law otherwise allows, you will compensate us for claims by third parties, including your tenants, that arise from information you entered without the right to do so, or from your breach of these terms or the law.
12. Ending the agreement
You can stop using LandlordLog and close your account at any time. We may suspend or close an account that misuses the service or seriously breaches these terms, with notice where reasonable. If we close your account without a breach by you, we will refund any unused part of a prepaid plan.
13. Disputes and governing law
- Please contact us first at support@landlordlog.ca; most problems can be fixed quickly.
- These terms are governed by the laws of British Columbia and the federal laws of Canada that apply there. Nothing in these terms requires you to use arbitration or prevents you from going to the Civil Resolution Tribunal, a court, or taking part in a class proceeding.
14. General
- These terms and the privacy policy are the whole agreement between us about LandlordLog.
- If any part is found unenforceable, the rest stays in effect.
- If we do not enforce a term right away, we have not given up the right to enforce it later.
- We are not responsible for delays caused by events outside our reasonable control, such as outages at our service providers.
- We may transfer this agreement to a business that takes over LandlordLog, if your rights under it are not reduced. We will tell you if that happens.
- Nothing in these terms prevents you from publishing an honest review of LandlordLog.
